1. Intellectual property
The publication TERRITORIAL CHALLENGES is the exclusive property of the publishing company EIRL SIR NIDAM ABDI. All its contents are protected by French and international laws relating to copyright and intellectual property.
Subscriptions to an individual subscription (hereinafter the Subscriptions) do not result in any transfer of ownership rights of any kind whatsoever to the benefit of the Client (the term Client means any beneficiary or administrator of a Subscription).
2. Distribution methods
The contents of the Territorial Challenges publication can be consulted under the following formulas :
has. Individual Subscriptions
Individual subscriptions are strictly personal. For consultation of publications and access to online services, Subscribers are required to provide a personal email address. All or part of the content may not be shared in any way, whether within an organization or externally. Editions and individual articles may not be distributed by email, on an intranet or extranet, or reproduced on a blog or social media..
b. Multi-reader Licenses
Multi-reader Licenses make it possible, via a single invoice, to manage collective Subscriptions within the same legal structure (subsidiaries excluded, unless agreed by the publisher MONSIEUR NIDAM ABDI). These formulas are suitable for professionals working in services where the collective use of our articles is essential to the smooth running of their activity. They benefit from advantageous decreasing rates, but require Customers to respect the same intellectual property rules as individual Subscriptions.
There are three types of Licenses:
• Named Licenses are intended for the exclusive use of Subscribers in whose name they are subscribed by name and to whom they are addressed. To consult publications and access online services, Subscribers are required to provide a personal email address (e.g. jean.martin@entreprise.fr).
• Collective Licenses are aimed at a group of readers who belong to the same legal structure, but who are not individually identified. For consultation of publications and access to online services, Subscribers have a collective email address. This identification formula is available for collective licenses including 10 or more readers.
• IP Licenses are aimed at a set of readers who use IP address ranges belonging to the same legal structure to connect to our publications. Readers are not individually identified. To receive summaries and alerts by email, readers can create an account with a named email address.
3. Extraction and Indexing Restrictions
The archives of the Territorial Challenges publication are organized into databases accessible to Subscribers as part of their License. However, under article L342-1 of law n°98-536 of July 1, 1998 of the French Code of intellectual property (transposition of directive 96/9/EC of March 11, 1996) the publisher MONSIEUR NIDAM ABDI prohibits “the extraction, by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the content of a database on another medium, by any means and in any form whatsoever”.
Concretely, the use of robots to extract a substantial part of the Territorial Challenges databases is prohibited, unless written authorization is obtained.
4. Responsibilities of Authorized Readers
Whatever the formula subscribed to, only a private copy is allowed for each user.
The reader authorized under a Subscription or License may print an article or an edition, and download them for his or her personal use, but may under no circumstances distribute it to third parties, including within his or her own company (whether by email, hard copy or intranet).
The distribution on social networks of articles published on Territorial Challenges is strictly prohibited, unless it is a quote or a short extract.
The authorized reader undertakes to keep his password secret, and not to disclose it in any form whatsoever to third parties.
5. Specific Responsibilities of the License Administrator
The Administrator responsible for managing a License guarantees acceptance and compliance with these General Conditions of Sale and Use (CGVU) for all readers authorized under this License.
6. Subscription and management of Subscriptions and Licenses
Subscription to online support
Registration conditions – creating an online account
Access to and consultation of the Publication and/or a subscription-based Service in electronic format requires the Subscriber to create an account on the Site, a unique and personal account for the Subscriber. The Subscriber undertakes to provide truthful, accurate information,
up to date and complete on his identity, his function, the identity of his company as well as any information requested in the Order Form. He undertakes to update his account information as soon as necessary. In the event that the Subscriber provides false, inaccurate, outdated or incomplete registration data, the Publisher will be entitled to suspend or terminate his Subscriber account without notice and to refuse him access immediately and for the future. to all or part of the Publication and/or the Service, without having to reimburse the amounts paid. The Subscriber is solely responsible for the use that may be made of his account, and the sole guarantor of the confidentiality of his access data. He undertakes to inform the Publisher immediately of any unauthorized use of his account, and/or any breach of the confidentiality and security of his means of identification. The Publisher cannot under any circumstances be held responsible for any loss or damage resulting from any breach of the obligations contained in this article. The Subscriber is responsible for setting up the IT and telecommunications means allowing access to the Site. The Subscriber is responsible for telecommunications costs when accessing the Internet and using the Site and the Services to which he has subscribed.
Management of Subscriptions and Licenses
Any order for a Subscription or License implies thefull acceptance and without subject to these General Conditions of Sale and Use.
Start date – The Subscription or License takes effect upon receipt of the order when it comes to a new Subscription. Upon renewal, the new Subscription or the new License takes effect following the Subscription or the previous License. For any other provision (retroactive subscription, implementation on a specific date, etc.), it is necessary to specify this at the time of ordering.
Cancelation – Orders for Subscriptions and Licenses are deemed firm and definitive from their receipt by the publisher MONSIEUR NIDAM ABDI. According to legal provisions, a right of withdrawal can be exercised by the Customer for 14 days after ordering. The Customer will however be liable for an amount calculated pro rata to the duration of Subscription or License served between registration of the order and its cancelation.
Non-transferability – The Subscriber cannot assign all or part of the rights and obligations resulting from the present to a third party, without the express prior authorization of the Publisher.
Disputes – Any complaint must, under penalty of forfeiture, be made by letter registered with acknowledgment of receipt. Any dispute, whatever its nature, will be subject to the jurisdiction of the Nanterre courts which will apply French law.
Automatic resubscription – By opting for automatic resubscription, the Subscriber benefits each year from a discount of 10% on the basic rate. Six weeks before When his subscription expires, he receives an invoice corresponding to his resubscription for a year. If he does not wish to resubscribe, he simply has to return this invoice with the marked “Canceled”, within six weeks following the invoice date. Beyond this period,no cancellations will be accepted. The Subscription or License will be considered as renewed and the corresponding amount will be due in full.
Cookies
A “Cookie” allows the identification of the User, the personalization of their consultation of the site www.territorialchallenges.com and the acceleration of the layout of the site thanks to the recording of a data file on their computer . The cookies that we issue are used to establish traffic statistics for our site in order to improve the interest and ergonomics of our services.
The User acknowledges being informed of this practice and authorizes EIRL Nidam ABDI to proceed with it.
In any case, EIRL Nidam ABDI undertakes never to communicate death content “Cookies” to third parties, except in the event of legal requisition. The User can refuse the recording of “Cookies” or configure their browser to be notified before accepting “Cookies”. To do this, the User configures their browser from the “tool” menu for Microsoft Internet Explorer. Regarding Google Cookies which are authorized by default, you can modify this setting in the “options” dialog box.
8. Payment terms
An invoice for the amount of the Subscription and the License is issued when the service is set up. It can also be sent by the publisher MONSIEUR NIDAM ABDI to the Customer (or to the billing contact he designated during subscription). Invoice requests should be sent to contact@territorialchallenges.com.
Payment period – Payment for the Subscription or License is due upon receipt of the invoice, and must be made within a maximum period of 30 days from this receipt. In the event of late payment, the Subscription or License will be suspended until receipt of payment of the full invoice amount. If the Customer has several current subscriptions, non-payment of one of them within this deadline implies the suspension of all subscriptions until receipt of the missing payment.
Means of payment – The publisher MONSIEUR NIDAM ABDI accepts payments in euros (EUR), US dollars (USD) or pounds sterling (GBP), made by the means below:

- Visa, Mastercard
- American Express (only in EUR or USD)
– Bank check payable to MONSIEUR NIDAM ABDI
– Bank transfer. The costs of issuing the transfer by the client's bank are the client's responsibility.

9. Personal data and respect for privacy
The company MONSIEUR NIDAM ABDI strictly complies with the laws in force on the protection of privacy and individual freedoms, and in particular with the General Data Protection Regulation (GDPR) which entered into force in the European Union in May 2018. Only MONSIEUR NIDAM ABDI's commercial service provider, which is subject to strict confidentiality rules, has access to customer and prospective information. No computer processing is subcontracted to a third party company. MR. NIDAM ABDI undertakes never to disclose to third parties the information that the Client (whether Administrator or Reader) communicates to him. In accordance with the French Data Protection Act of January 6, 1978, the Customer has a right of access, rectification and opposition to personal data concerning him. You can refuse to receive promotional messages by modifying your personal information online or by sending a request to customer service (contact@territorialchallenges.com).
10. Modifications & Compliance with these conditions
MONSIEUR NIDAM ABDI reserves the right to modify these General Conditions of Sale and Use at any time.
MONSIEUR NIDAM ABDI reserves the right to interrupt or close any Subscription or License which contravenes the General Conditions of Sale and Use explained above.
